Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ampost ("we," "our," or "us"), a unified social media API platform. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions
- "Service" — the Ampost API platform, website, dashboard, and all related tools and features.
- "User," "you," "your" — the individual or entity using the Service.
- "Content" — any text, images, video, or other media you submit, publish, or schedule through the Service.
- "Connected Platforms" — third-party social media platforms you link to the Service (Instagram, Facebook, X/Twitter, LinkedIn, TikTok, YouTube, Threads).
- "API" — the Ampost REST API and associated endpoints, SDKs, and documentation.
2. Account Registration and Responsibilities
You must register for an account to use the Service. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Keep your credentials (API keys, passwords, OAuth tokens) secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 16 years old to use the Service. By registering, you represent that you meet this age requirement.
3. API Usage and Rate Limits
Access to the Ampost API is subject to rate limits based on your subscription tier. You agree to:
- Respect the rate limits documented in our API Reference
- Not attempt to circumvent rate limits through multiple accounts or other means
- Use the API only for lawful purposes and in accordance with our documentation
- Not reverse engineer, decompile, or extract the source code of the Service
- Not use the API in a manner that could damage, disable, overburden, or impair the Service
We reserve the right to throttle, suspend, or terminate API access for accounts that exceed rate limits or engage in abusive usage patterns.
4. Acceptable Use Policy
You agree not to use the Service to:
- Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Distribute spam, unsolicited messages, or engage in coordinated inauthentic behavior
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Violate the intellectual property rights of others
- Distribute malware, viruses, or any other harmful code
- Engage in any activity that violates the terms of service of any Connected Platform
- Use the Service for any activity that violates applicable laws or regulations
We reserve the right to review content and suspend or terminate accounts that violate this policy, at our sole discretion.
5. Third-Party Platform Compliance
When you connect social media platforms to Ampost, you remain bound by each platform's own terms of service and policies. You are solely responsible for:
- Complying with the terms of Instagram, Facebook, X/Twitter, LinkedIn, TikTok, YouTube, and Threads
- Accepting that Ampost's current LinkedIn launch surface is limited to member-profile publishing and does not include organization/Page posting, analytics, or comment-management APIs unless Ampost explicitly enables them later
- Accepting that YouTube uploads may remain private until Google verification or audit approval is complete, even if you request public or unlisted visibility
- Accepting that TikTok creator publishing is immediate-only in the current launch and that TikTok may limit the connected app to private-only posting until app review or Direct Post approval allows broader visibility
- Ensuring your content meets each platform's content guidelines and policies
- Providing accurate LinkedIn visibility choices, article metadata, alt text, and any other LinkedIn-specific settings you send through Ampost
- Providing accurate YouTube metadata and disclosures, including audience settings and synthetic-media disclosures where required
- Any actions taken by each platform against your account or content (suspension, removal, bans)
Ampost is not responsible for any actions taken by Connected Platforms, including account suspensions, content removals, or API access revocations.
6. User Content
You retain all ownership rights to the content you submit, publish, or schedule through the Service. By using the Service, you grant us a limited, non-exclusive license to transmit your content to the Connected Platforms you designate, solely for the purpose of providing the Service.
You represent and warrant that:
- You own or have the necessary licenses, rights, consents, and permissions to publish your content
- Your content does not infringe any third-party intellectual property rights
- Any TikTok-specific declarations you provide through Ampost, including privacy level, disclosure flags, duet/comment/stitch settings, and creator-publishing eligibility assumptions, are accurate to the best of your knowledge
- Any YouTube-specific declarations you provide through Ampost, including visibility, made-for-kids, and synthetic-media flags, are accurate to the best of your knowledge
- Any LinkedIn-specific declarations you provide through Ampost, including visibility, article metadata, or media accessibility text, are accurate to the best of your knowledge
7. Intellectual Property
The Service, including its code, design, trademarks, logos, API documentation, and brand identity, is owned by Ampost and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except the limited right to use it as described herein.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not use our trademarks or branding in a way that suggests endorsement without permission.
8. Payment and Billing
Certain features of the Service are available only through paid subscription plans. By subscribing to a paid plan, you agree to:
- Pay all fees associated with your chosen plan, as described onour pricing page
- Provide valid payment information and authorize recurring charges
- Understand that fees are non-refundable except as required by applicable law
We reserve the right to change our pricing upon 30 days' notice. Price changes will not affect your current billing period. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
We offer a 14-day money-back guarantee. If you are not satisfied, contact us at refunds@ampost.io within 14 days of your initial purchase for a full refund. No questions asked.
EU consumers have a 14-day right of withdrawal from the date of purchase for digital services. By starting to use the Service immediately, you expressly consent to the immediate provision of the Service and acknowledge that you lose the right of withdrawal.
9. Legal Guarantee of Conformity
We guarantee that the Service conforms to the description provided on our website and functions as reasonably expected for a period of 2 years from the date of purchase (or for the entire duration of a continuous subscription). If the Service is defective or non-conforming, we will bring it into conformity within a reasonable time, free of charge. If we cannot do so, you are entitled to a price reduction or contract termination.
10. Service Availability and Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, or error-free
- Third-party Connected Platform APIs will remain available or compatible
- Any errors or defects will be corrected
- The Service is free of viruses or harmful components
We strive to maintain high availability but may need to perform maintenance or experience outages. We are not liable for disruptions caused by third-party services (Connected Platforms, Supabase, Vercel).
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMPOST, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any content posted or actions taken on Connected Platforms through the Service
- Unauthorized access to or alterations of your transmissions
- Any bugs, viruses, or other harmful code transmitted through the Service
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ampost and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your content, including any claims of intellectual property infringement
- Your violation of these Terms
- Your violation of any third-party rights or applicable laws
13. Termination and Service Discontinuation
You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease, and we will delete your data in accordance with our Privacy Policy.
Connected-platform content that has already been published, including LinkedIn or YouTube posts, may remain on the third-party platform after you disconnect or terminate Ampost unless you remove that content directly on the third-party platform.
We may suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include violation of these Terms, violation of a Connected Platform's terms, extended inactivity, or at our sole discretion.
We reserve the right to discontinue the Service at any time. If we decide to discontinue the Service, we will provide at least 30 days' notice via email and through the Service. Upon discontinuation, your subscription will be cancelled and you will receive a prorated refund for any prepaid unused period. You are responsible for exporting your data before the discontinuation date.
Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Poland and, where applicable, European Union law, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
Any dispute arising out of or relating to these Terms shall first be submitted to amicable negotiation. If no resolution is reached within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Poland.
If you are a consumer residing in the EU, you may also bring proceedings in the courts of your country of residence. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service.
